Terms of Service
AGREEMENT
- These Terms of Service are an agreement made between you (the client) and DaBrohan (me), concerning your commission creation process and use of any works- You agree that by submitting an application to me, you have read, understood, and agree to be bound by these Terms of Service
General
-I retain the right to reject any commissions that I, as the artist, deem fit.-Timeframes will be flexible as needed depending on various circumstances. (life events, emergencies, power outages, etc) Changes to any estimated time frames will be communicated to you at ASAP.-Permission is needed to create any alterations to a completed piece by anyone other than me.-Any "For Profit" use of any pieces provided by me, i.e. merchandising, will subject you to additional charges upon the pieces completion.-Commissions will be completed in order they are received unless a rush order is placed. Rush orders do come with additional charges. I consider ALL orders with a deadline a rush order.-While not explicitly expressed, I am both open and capable of doing NSFW art.
My Use
-I maintain the right to display the commissioned piece in any stage on my platforms. This includes streaming all stages of the creation process, posting updates or final product on twitter, instagram, etc.-NDA's are available if client wishes to have a big reveal.-NDA's must be requested AT FIRST DISCUSSION.
Your Use
-You retain the right to share publicly any pieces you have commissioned from me on all platforms WITH the appropriate credits. *see below for credit details-You have the right to request alterations during the creation process. Free alterations are no longer allowed after final work has begun.-You may request alterations after final process has started at additional cost. PLEASE HAVE SUFFICIENT REFERENCES TO AVOID THIS.-If commissioned pieces are intended for monetary gain or have potential for monetary gain in the future, commercial use fees will apply.
Fees & Payments
-Payments for all commissions will be in two parts. 50% at start of commission and rest upon completion.-Payment can be made in full upfront.-Initial payment is required AT START of commission.-Rush orders will be subject to up to 20% of commissioned value. Actual percentage will be based upon number of projects ongoing as well as date of deadline.-For any piece intended or future potential for monetary gains a 10% commercial use fee will be processed.-Late stage alterations will be subject to a 10% alteration fee.-Payments are accepted through PayPal & CashApp. If those methods are unavailable, other methods may be discussed.
Refunds
-Full refunds are only available before a piece has been started-The 50% upfront payment will be non-refundable after the piece has been started.-If piece is fully completed to the agreed upon specification, no refunds are available.-Any additional fees are not included in any refunds.
Credits
Credit is required when publicly sharing a commissioned piece. This includes locations such as Twitch, Youtube, Carrd, Twitter, Instagram, etc. A proper credit must include any of the following names AND any of the following links:Name:
